Terms and Conditions for Jackson Interior Design

1. Introduction

‍The terms and conditions applying to services provided by Kirsty Jackson, trading as Jackson Interior Design (“Jackson Interior Design”/ “we”) are set out below.  These include terms and conditions applying to the specific service package you have chosen and also general terms and conditions which apply to all services (i.e. whichever service package is chosen).

2. Colour Consultation Terms and Conditions

‍A. Fees and Payment ‍ ‍

i. A design fee of £160 (the “Design Fee”) is payable to Jackson Interior Design for the Colour Consultation.

ii. The Design Fee is payable in full before Jackson Interior Design commences any work on your behalf, no later than 5pm on the day prior to the Colour Consultation meeting.

B. Design Services

‍i. The Colour Consultation service includes a one-hour consultation meeting with Kirsty Jackson, either in person at your home or remotely. You will also receive a Digital Colour Consultation Package by email summarising everything discussed in the meeting.

ii. The Colour Consultation service is a one-off service which does not provide for design revisions or additional design support beyond the one-hour consultation meeting. We are however confident that the proposed colour scheme will deliver to your requirements.

iii. It is your responsibility to implement the colour recommendations in your home.

‍C. Costings and Third Parties ‍ ‍

i. The Design Fee does not include sourcing or purchase of goods from third party suppliers, quote gathering, or project implementation.

3. Design Consultation Terms and Conditions

‍A. Fees and Payment

‍i. A design fee of £320 (the “Design Fee”) is payable to Jackson Interior Design for the Design Consultation.

ii. The Design Fee is payable in full before Jackson Interior Design commences any work on your behalf, no later than 5pm on the day prior to the first one-hour consultation meeting.

‍B. Design Services

‍i. The Design Consultation service includes two one-hour consultation meetings with Kirsty Jackson, either in person at your home or remotely. You will also receive a Digital Design Consultation Package by email summarising everything discussed in the meetings. In the four weeks following receipt of this email, you can email Kirsty with any queries you may have about the advice provided, free of charge.

ii. The Design Consultation service is a one-off service which does not provide for design revisions or additional design support beyond the final meeting. We are however confident that the design will deliver to your requirements due to the two-stage process of initial Design Concept, which we will agree with you, before progressing to the final Detailed Design.

iii. It is your responsibility to implement the design recommendations in your home.

‍C. Costings and Third Parties

i‍. The Design Fee does not include sourcing or purchase of goods from third party suppliers, quote gathering, or project implementation.

4. One Room Design Package (Self-Implement) Terms and Conditions

‍A. Fees and Payment

‍i. A design fee of £1,400 (the “Design Fee’) is payable to Jackson Interior Design for the One Room Design Package.

ii. The Design Fee is payable in two parts. £700 is payable in full before Jackson Interior Design commences any work on your behalf, following receipt of your completed client questionnaire, and no later than 5pm on the day prior to the first one-hour consultation meeting. The remaining £700 is payable following the second and final one-hour consultation meeting, and no later than 5pm three working days following the final appointment. The Digital Design Package and physical sample pack will not be issued until payment is received in full.

‍B. Design Services

‍i. The One Room Design Package includes two one-hour consultation meetings with Kirsty Jackson either in person at your home or remotely. You will also receive a Digital Design Consultation Package by email summarising everything discussed in the meetings. The content of this will vary depending on the scope agreed in the scope document (the “Scope Document”). You will also receive a physical sample pack. In the four weeks following receipt of this email, you can email Kirsty with any queries you may have about the advice provided, free of charge.

ii. The One Room Design Package is a one-off service which does not provide for design revisions or additional design support beyond the final meeting. We are however confident that the design will deliver to your requirements due to the two-stage process of initial Design Concept which we will agree with you, before progressing to the final Detailed Design.

iii. It is your responsibility to implement the design recommendations in your home.

‍i. The Design Fee does not include purchase of goods from third party suppliers, quote gathering, or project implementation.

5. Fully Flexible Interior Design Services Terms and Conditions

‍A. Fees and Payment

‍i. For the Fully Flexible Design Service we will charge a design fee based on time incurred of £80 per hour or £450 per day (7 hours to be used within 8 weeks) (“Design Fee”).  Before we commence work, we will agree with you a scope of services and provide an estimate of the Design Fee in respect of that scope.  That is, however, an estimate only and the Design Fee will be based on the amount of time actually incurred by us in carrying out the agreed scope of services.

ii. All time spent by us on interior designs, travel, consultancy, research, visits to specialist suppliers, studio time, project management time, collection and deliveries will be included in the Design Fee.

iii. An initial instalment of £450 towards the Design Fee is payable in full before Jackson Interior Design commences any work on your behalf, following receipt of your completed client questionnaire, and no later than 5pm on the day prior to the first consultation meeting. This amount will be credited against invoices until the Design Fee has exceeded that figure.

iv. The Design Fee is payable monthly in arrears. You will be issued with an invoice at the start of each calendar month, for work completed in the previous month. This invoice is payable within 5 working days of it being sent to you.

v. If we are required to spend extra time, or if we incur third party costs, as a result of any of the following:

a. you do not provide us with the information you have agreed to provide within the agreed timescale;

b. you do not carry out the preparatory work you have agreed to carry out within the agreed timescale;

c. you are not at your property to receive deliveries or give access to tradespeople as previously agreed with us; or

d. you otherwise do not do something which you have previously agreed with us to do,

then we will include within the Design Fee the extra time incurred by us as a result and the amount of any such third party costs incurred by us.

6. General Terms and Conditions That Apply to All Services

‍A.     Trading Name

i. Jackson Interior Design is a trading name of Kirsty Jackson.

B. Where to find information about us and our services

i. You can find everything you need to know about us, Jackson Interior Design, and our services on our website www.jacksoninteriordesign.co.uk before you book one of our services. We also confirm the key information to you in writing, by email, before any payment is taken.

‍C.     Your Acceptance of the Terms and Conditions‍

i. You accept these terms and conditions when you make your first payment to us or (if earlier) when you confirm to us you would like us to proceed with the services.

‍D.     Fees and Payment

i. We charge interest on late payments. If we are unable to collect any payment you owe us we charge interest on the overdue amount at the rate of 8% a year above the Bank of England base rate from time to time. This interest accrues on a daily basis from the due date until the date of actual payment of the overdue amount, whether before or after judgment. You pay us the interest together with any overdue amount.

ii. We will pass on the cost of any VAT charged on goods ordered on your behalf. 

‍E.      Design Services

i. Where you require additional design work or communication beyond the agreed scope, Jackson Interior Design reserves the right to charge on a time-cost basis (based on the hourly/daily rates set out in the section above headed “Fully Flexible Interior Design Services Terms and Conditions”) for the additional work required.

ii. We will notify you of the additional Design Fee for additional work and we will need you to pay that in full before any further work is carried out on your behalf.

‍F.      Specifications

i. If we ask you to provide measurements to us, we will rely on the measurements you provide.

ii. It is your responsibility to check the measurements of any items specified to ensure that they fit in the space suggested. It is also your responsibility to ensure that large items of furniture will fit into the property and the specified room.

‍G.    Costings and Third Parties

‍i. We cannot be held responsible for changes in price, stock availability and accuracy of any information in the FF&E (Furniture, Fixtures and Equipment) or other schedules provided.

ii. We cannot be held responsible for delays outside our control. If our supply of your service is delayed by an event outside our control, such as a delay by a third party in the provision of bespoke products, we will contact you as soon as possible to let you know and do what we can to reduce the delay. As long as we do this, we will not compensate you for the delay, but if the delay is likely to be substantial you can contact us at hello@jacksoninteriordesign.co.uk, or call us on 07932 611451 to end the contract and receive a refund for any services you have paid for in advance, but not received. However, you will remain liable for any third party costs which have been incurred and cannot be cancelled or the cancellation fee if they can be cancelled.

iii. Where we arrange for third party trades to deliver certain elements of your design, unless we agree otherwise in writing, you will be required to contract with them directly and they will invoice you directly for payment. As your contract will be with them, we will have no liability to you in contract, tort (including negligence), breach of statutory duty, or otherwise, in respect of their goods or services. Also, we cannot be held responsible for changes in price and availability of any services provided by third party trades.

iv. Where part of the service we provide to you requires us to purchase items on your behalf (for example to secure a trade discount for you), we will issue you with an invoice for payment and require cleared funds in our account prior to us placing the order.

‍H.    Privacy and Data Protection

‍i. Any personal information provided by you to Jackson Interior Design will only be used in accordance with Jackson Interior Design Privacy Policy, which can be read here: https://www.jacksoninteriordesign.co.uk/privacy-policy

‍I.        Intellectual Property

i. All communications, designs, sketches, drawings, models, mood boards, plans, schedules and photography that Jackson Interior Design produces are the intellectual property of Jackson Interior Design at all times and full copyright on them is reserved at all times. This means you should not copy or share them in the public domain without Jackson Interior Design’s prior written consent. Jackson Interior Design reserves the rights to use all designs created for you on its website, on social media platforms and in other promotional material. You will never be identified and we will always respect your privacy.

‍J.       Performance and Early Termination

‍i. Jackson Interior Design relies on you providing all requested information and clear instructions in order to fulfil its obligations under this agreement. It is your responsibility to provide accurate information and clear instructions in a timely manner.

ii. We can end our contract with you (or suspend or terminate any work in progress) and claim any compensation due to us if:

a. you do not make any payment to us when it is due and you still do not make payment within 5 working days of our reminding you that the payment is due; or

b. you do not, within a reasonable time of us asking for it, provide us with information, cooperation or access that we need to provide the service.

‍If such termination (or suspension) occurs, you are not entitled to any refund of the Design Fee (or any other sums) charged to that point and you may be issued with a further invoice for work in progress. Any refund is issued entirely at the discretion of Jackson Interior Design.

‍iii. If at any point you decide you want work to stop, you are not entitled to any refund of the Design Fee charged to that point and you may be issued with a further invoice for work in progress. Any refund is issued entirely at the discretion of Jackson Interior Design.

K.      Cancellation Rights – Services Bought Online or Over The Telephone

i. For  services bought online or over the telephone, you have 14 days after the date we confirm your order to change your mind about a purchase, but you lose the right to cancel any service which has been carried out before you cancel (and you must pay for any services provided up to the time you cancel).

ii. If you wish to cancel within the 14-day period, please contact us by email at hello@jacksoninteriordesign.co.uk, or call us on 07932 611451. We will refund you as soon as possible and within 14 days of you telling us you've changed your mind. We refund you by the method you used for payment. We do not charge a fee for the refund.

‍L.      Limitations on Our Liability to You

i. We are not responsible for losses you suffer caused by us breaking this contract if the loss is:

a. unexpected, i.e. it was not obvious that it would happen and nothing you said to us before we accepted your order meant we should have expected it (so, in the law, the loss was unforeseeable);

b. caused by a delaying event outside our control; or

c. avoidable, i.e. something you could have avoided by taking reasonable action, including following our reasonable instructions in relation to the relevant matter.

ii. Our total liability to you for all losses arising under or in connection with any contract between us, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall be limited to 1.5 times the amount of the Design Fee (for the avoidance of doubt excluding amounts paid for goods ordered on your behalf) which you have paid us.

‍M.    Other important terms apply to our contract

i. Nobody else has any rights under this contract. This contract is between you and us. Nobody else can enforce it and neither of us will need to ask anybody else to sign-off on ending or changing it.

ii. If a court invalidates some of this contract, the rest of it will still apply. If a court or other authority decides that some of these terms are unlawful, the rest will continue to apply.

iii. Even if we delay in enforcing this contract, we can still enforce it later. We might not immediately chase you for not doing something (like paying) or for doing something you are not allowed to, but that does not mean we cannot do it later.‍ ‍
